Conditions of Use
YOU UNDERSTAND AND AGREE THAT YOU WILL BE LEGALLY BOUND BY AND COMPLY WITH THIS AGREEMENT BY ACCESSING OR USING THE MAGAZINE SERVICES. DO NOT ACCESS OR USE THE MAGAZINE SERVICES IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT. Please be specifically aware that, with very few exceptions, all disputes pertaining to this agreement between you and us will be resolved by individual binding arbitration rather than jury trials in court, including class action lawsuits, and that you will only be entitled to specific remedies. Section 23: Dispute Resolution (Arbitration Clause and Class Action Waiver) has further information.

We outline the terms and conditions that govern your use of our U.S. website, mobile application, digital membership product, other digital service, and print or online magazine subscription (collectively, “Magazine Services”) in the Highlights section. For a thorough explanation of the relevant terms and conditions, please read the whole Terms of Use below. Any mention of the Terms of Use in the Highlights section, including any of its parts, is meant to relate to the complete Terms of Use that are provided below.

Highlights
Application and Acknowledgment of the Use Terms
Every time you access or use a feature of the Magazine Services that are owned or run by Hearst Magazine Media, Inc. or its affiliates (“we,” “us,” “our,” or “Hearst”), you agree to be bound by the terms of use as well as our privacy notice and any additional policies, guidelines, procedures, or rules that may apply.
You understand that we will abide by our Privacy Notice when using any information we learn about you in relation to your use of the Magazine Services and access to them.
Additional conditions, such as those pertaining to your membership’s auto-renewal, apply if you purchase a digital membership and/or subscription product (referred to below as a “Digital Membership Product”).or abonnement.
Additional conditions pertaining to your membership’s auto-renewal and continuous service (referred to as the “Continuous Service Program”) apply if you purchase a print subscription.

You Have Duties
Regarding your use of and access to the Magazine Services, you are in charge of keeping any information you provide accurate.
Any user material you provide us is entirely your responsibility.
The rules outlined in the section of the Terms of Use below titled “Your Conduct and Responsible Use of the Magazine Services” apply to your access to and use of the Magazine Services and Content (as defined in the full Terms of Use). You are accountable for your behavior in relation to the Magazine Services.

Ownership of Intellectual Property and Other Rights
The Magazine Services and Content are only available to you for personal, noncommercial use.
With regard to the Magazine Services and Content, Hearst is the exclusive owner of all rights, title, and interest in and to the copyrights, trademarks, service marks, trade names, patents, and other intellectual and proprietary rights worldwide, with the possible exception of your User Content.
You are not allowed to use any component of the Magazine Services (including any code used in any program) or Content to develop a company, whether for profit or not, or to resell, disseminate, recirculate, or make any other commercial use of it.
If we learn that any We reserve the right to take action to remove a user from the Magazine Services if they have violated the intellectual property rights of others on several occasions. We reserve the right to take action to remove a user’s access to the Magazine Services if we learn that the user has violated the intellectual property rights of third parties on multiple occasions. In our sole discretion, we reserve the right (but not the duty) to examine any User Content, look into it, and/or take necessary legal action against you.

Release, Limitation of Liability, Indemnity, and Disclaimers
You undertake to defend and hold Hearst (as well as its affiliates, officers, directors, employees, contractors, and agents) harmless from any third-party claim or demand resulting from (a) your use of the Magazine Services or Content; (b) your User Content; (c) your violation of the Terms of Use; or (d) your violation of any applicable laws or regulations. This defense will include costs and reasonable attorneys’ fees.
Hearst offers the Magazine Services “as is” and disclaims any warranties.
As outlined in the section below on Limitation of responsibility in the Terms of Use, our responsibility is restricted.
Other Parties
Any connections to websites, applications, or other services operated by third parties are not within Hearst’s control.

We engage in affiliate marketing, and on certain of our magazine services, we could permit the encoding of affiliate links from third parties. This implies that if you use third-party affiliate links to click on links or make purchases, we could get paid a fee.

Termination
Without giving you any advance notice and for any reason or no reason at all, Hearst retains the right to terminate your password, account (or any portion thereof), access to or use of the Magazine Services, as well as to remove and discard any User Content (as that term is defined in the Terms of Use below) and information sent, received, or stored via the Magazine Services.
Modifications to the Usage Policy
We reserve the right to alter the Terms of Use in the future and to display the revised text on the Magazine Services.
Any updates shall be assumed accepted in full by your continuing use of the Magazine Services.
Severability and Governing Law
The State’s laws will be the exclusive source of guidance and interpretation for the Terms of Use.

The complete agreement between you and us about the use of the Magazine Services is included in the Terms of Use, which also includes the Privacy Notice.
The other elements of the Terms of Use will remain unaffected and the invalid or unenforceable provision will be deemed changed to the greatest degree permissible by law if any provision is found to be invalid or unenforceable for any reason.

You may provide us notice in line with the procedure outlined in the relevant part of the Terms of Use below if you think your copyright has been violated.
